Servicemembers Civil Relief Act

The United States Supreme Court stated that the purpose of the Servicemembers Civil Relief Act (SCRA) is to “Protect those who have been obliged to drop their own affairs to take up the burdens of the nation.” Boone v. Lightner, 319 U.S. 561, 575 (1943).

The SCRA is designed to ease financial burdens on servicemembers during periods of military service. This law provides consumer protections to servicemembers by limiting the amount of interest they can be charged, enabling servicemembers to terminate leases upon receipt of valid orders, and setting aside default judgments for servicemembers who are unable to attend court hearings because of their military service. 

Despite these protections, the sad reality is that many servicemembers and their families fall victim to unfair and deceptive practices that often lead to debt. And, debt collectors view Servicemembers as easy prey because bad debts can derail a military career.

Robert Mitchell uses the SCRA and the Fair Debt Collection Practices Act to protect servicemembers and their families from harmful and abusive businesses and debt collectors. This often includes correcting credit reports, under 15 U.S.C.  § 1692e(8).
